Terms of Service
1. Scope
These Terms of Service apply to the use of the service Moin.Zone, operated by the provider explicitly named in the imprint (hereinafter referred to as "Provider").
Moin.Zone is a "link-in-bio" service that allows users to create personalized landing pages to aggregate links to their social media profiles, websites, and other content.
2. Services
The Provider offers users a platform where they can create, design, and populate their own profiles ("Zones") with content (links, text, images).
The service is offered in a free basic version ("FREE") and potentially optional paid extensions ("PRO"). The Provider reserves the right to modify, expand, or limit the scope of services at any time, provided this is reasonable for the user.
3. Registration and User Account
Registration is required to use Moin.Zone. The user agrees to provide truthful and complete information.
The user is solely responsible for the security of their login credentials (email, password). All actions taken under the user's account are attributed to the user.
4. User Content and Responsibility
The user retains all rights to the content they post. However, by posting content, the user grants the Provider the non-exclusive, worldwide, royalty-free right to store, reproduce, and make this content publicly available for the purpose of providing the service.
The user is solely responsible for the content they post. It is prohibited to post content that:
- violates applicable laws,
- infringes copyright, trademark, or other intellectual property rights of third parties,
- is insulting, defamatory, racist, or incites hatred,
- glorifies pornography or violence,
- contains malware or viruses.
The Provider does not generally pre-screen user content. However, the Provider reserves the right to delete content that violates these Terms and to block the user's access without prior notice.
5. Availability and Liability
The Provider strives for the most uninterrupted availability of the service possible. However, no guarantee can be given for 100% availability (e.g., due to maintenance or technical faults).
The Provider is liable only for damages based on intent or gross negligence. In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal duties).
6. Term and Termination
The user agreement runs for an indefinite period. The user can delete their account at any time, thereby terminating the agreement.
The Provider is entitled to terminate the contractual relationship with a notice period of two weeks. The right to extraordinary termination for good cause (e.g., in the case of serious violations of these Terms) remains unaffected.
7. Changes to Terms
The Provider is entitled to change these Terms of Service at any time with effect for the future. The user will be informed of changes in good time. If the user continues to use the service after the changes take effect, the amended Terms are deemed accepted.
8. Final Provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction is, to the extent permitted by law, the registered office of the Provider.
